Membership Agreement for Small Construction Repairs
This Membership Agreement ("Agreement") is made and entered into on this
day of , 2025, by and between:
2. Membership Term
This Agreement shall commence on the Effective Date and continue for a period of one (1) year, unless terminated earlier in accordance with this Agreement. After the one (1) year anniversary this Agreement can be canceled at any time.
3. Membership Fees And Billing
The Member agrees to pay a monthly membership fee of Ninety-Nine Dollars ($99.00) per month, billed automatically on a recurring basis using the credit card or banking information provided by the Member. By signing this Agreement, the Member authorizes the Provider to keep the credit card on file and charge it each month, for a minimum of Twelve (12) months, for the agreed-upon membership fee. Fees are non-refundable except as explicitly stated in this Agreement.
4. Service Limitations
Services are subject to the following limitations:
- Services shall be provided up to one (1) time per month and a maximum of six (6) services per year.
- Any materials or specialized tools required shall be billed separately.
- Services do not include structural, plumbing, electrical, HVAC or any work requiring permits
- Services are limited to the Member’s above referenced residence per Section 1.
5. Scheduling And Availability
Any initial Service/Repair commences the first day following the thirtieth day of the initial payment of the Membership Agreement. Services must be scheduled at least Fourteen (14) days in advance and are subject to Provider’s availability. However, if Provider’s availability allows to schedule said service sooner than the Fourteen (14) day requirement, Provider will do its best to accommodate the Member. Emergency services will be offered with additional charges over and above the Monthly Membership Fee.
6. Offerred Services
The following services are offered by the Provider under the terms of this Membership Agreement. Any and all material and/or specialized tools shall be billed separately.
- Painting (must be less than 120 square feet) typically 10x12 room.
- Sheetrock repair (under a four-by-eight sheet).
- Fixture replacements (customer providing the fixture) no fans.
- Popcorn ceiling repair/respray.
- Doorknob and lock install (non-electrical).
- Plaster crack repairs (3 cracks per service call).
- Concrete step repairs (4 steps or less) does not Include resurfacing, only broken and cracked steps.
- Electrical outlet & light switch replacement.
7. Member Responsibilities
The Member agrees to:
- Provide safe working conditions and access to the premises.
- Ensure compliance with all applicable local regulations and laws.
- Notify the Provider of any hazardous conditions on the premises.
- Provide access to the Member’s above listed residence at the time of the scheduled service
- If the Member cannot provide access for the scheduled repair at the previously scheduled appointment time, then following Fifteen (15) minutes past the scheduled time, said scheduled repair will be counted as one of the annual six (6) repairs.
- Any scheduled repair must be canceled within Twenty-Four (24) hours or said scheduled repair will be counted as one of the annual six (6) contracted repairs.
8. Cancellation Policy
The Member agrees to:
- The Member may cancel this Agreement at any time with [30] days' written notice (signature required) to the Provider. Cancellation requests must be submitted in writing via email or certified mail. If Member cancels prior to the one (1) year anniversary Member is still responsible for the remaining months after cancellation to meet the one (1) year anniversary.
- If the Member cancels before the end of the term, any outstanding fees will be immediately charged to the Member’s credit card on file.
- The Provider reserves the right to terminate this Agreement immediately if the Member fails to make payments or violates any terms of service.
- The Provider reserves the right to terminate this Membership Agreement with no refund if the Provider and the Member have a breakdown in communication or suffer from fundamental disagreements.
9. Liability And Indemnification
Provider shall not be liable for incidental, consequential, or indirect damages arising from the services rendered. Member agrees to indemnify and hold Provider harmless from any claims, damages, or liabilities arising from work performed under this Agreement.
10. Dispute Resolution
Any disputes arising under this Agreement shall be resolved through mediation. If mediation fails, the dispute shall be settled in the courts of Connecticut.
11. Early Cancellation And Damages
If the Member cancels this Agreement before the completion of the agreed-upon one (1) year term, the Member agrees to pay any and all remaining Monthly fees and any other outstanding fees due under the Membership Agreement. The Provider reserves the right to recover any losses or damages resulting from early termination, including but not limited to administrative costs, legal costs and lost revenue.
12. Force Majeure
Neither party shall be held liable for failure or delay in performing obligations under this Agreement due to unforeseen circumstances beyond their reasonable control, including but not limited to natural disasters, government actions, pandemics, or labor strikes.
13. Governing Law
This Agreement shall be governed by the laws of the State of Connecticut.
14. Entire Agreement
This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements.
